Divorces can be very difficult, both legally and emotionally. The most common ground for obtaining a divorce is living separate and apart continuously for either six months or one year if there are children of the marriage. You may file as soon as you separate, or as soon as you intend on separating, under Louisiana Civil Code article 102; or you may file once the six months or one year has elapsed under Louisiana Civil Code article 103. Under article 103, you may also file if your spouse has committed adultery or has committed a felony and has been sentenced to death or imprisonment at hard labor. Divorces also include incidental matters, such as injunctive relief, harassment matters, use and occupancy of the family home, spousal support, child support, custody, visitation, and community property settlements.
